What can my friend do in this situation? What can my friend do in this situation?

Animaster888Animaster8887 dag(en) geledenAsk MFC
So this was sent to my server and I wanted to help my friend get some answers. I suggested contacting a lawyer but does anyone else have any suggestions? I edited what was written so I didn't have to mark this as 18+.

"I paid roughly 7000$ usd to NipponYasan in Jan. 2019 and all of the items have come out at least 2 months ago and they haven't shipped even after a slew of emails. I ended up asking to cancel and they said that they can't cancel a paid order. I ended up contacting my bank and NY banned my account and still haven't given me a refund. Does anyone have any idea of what to do?
I even sent them another email asking about the refund and when I tracked my ticket, they cancelled my ticket."

Update:12/2/19

I haven't heard much from the friend other than that they know a lawyer who specializes in foreign matters. They said that they will be contacting them. I'll update with more info as it comes.

Update: 12/2/19

I asked about the figures they ordered. It's a long list so this is the answer I got: "It's mostly a ton of prize figures, around 5-6 of each type depending on how well I think they'll do. Along with around 30 already released ones."

Update: 12/3/19

My friend got an email saying that the money is being refunded to their PayPal but upon checking, nothing is there. Does anyone know how long this might take?

Update: 12/4/19

My friend wanted me to mention that they didn't use explicit language in the emails to NY. They were afraid that it seemed like that. They also said: "I'm waiting on my paypal refund rn but I need the peeps on MFC to know that I am getting a refund. It wasn't 7000 in one order. It was 5 different orders.I split them in august and paid like 600 extra in shipping only to have them not ship it which confuses me."

Man like...I know companies aren't fond of cancelling orders because they order based on preorder amounts but...they still need to at least ship this stuff out even if they don't want to do buisness in the future with your friend. This is so fucked up how they are going about this. I am so sorry and I hope your friend gets this sorted out. I think at this point only their bank or paypal (if they used PP) can help now.

This makes me worried because Anime Island and Kirin Hobby were MFC partner sites before things started to go bad with them for their customers. I have some pre-orders with NY that are already pre-paid too and recently some of their customers have been saying stuff about NY having trouble with their shipments getting delayed or stopped.

Over here, businesses usually tell you it can take up to 14 days for your money to be refunded on PayPal, in case you decide to return or cancel an order. I hope it won't end up taking that long for your friend and that the money reaches them as soon as possible, I can imagine that staying calm in a situation as scary as that one is probably not very easy at all, I probably would be about to lose my mind if I had 7k on the line, haha.
Wishing your friend the best, I hope this unpleasant experience won't cause them to give up on the hobby, and that they will be able to enjoy figure collecting in the future. :^)

It could take like a week for the funds to go back into Paypal - I assume NY is refunding?

I really think your friend needed to just take a chill pill and relax and be patient in this situation, but at least they are getting their money back!

FixedCamera (5 dag(en) geleden) #71275378This makes sense to me too actually. If this is indeed what happened, do you think they flat out won't send the figures now given the situation? I don't know enough about what Japanese stores have done regarding blacklisting ppl and bans.

If you contact your provider or bank, then in their minds that you're gonna push through with the recovery of your funds. So it would be stupid for them to send those items voluntarily since it's possible that you continue with the fund recovery so they'll lose both the fund and the item.

Maybe if you can talk to them and assure them that you'll drop the recovery so they can ship the order. However, that would require trust between the parties which is obviously nil at this point.

Act (5 dag(en) geleden) #71273213View spoilerHide spoilerI'm with Jenthehen that this is sounding a bit off to me. NY has a crappy reputation, yes, but they're a huge, longstanding company, and the idea that they would just lose $7,000 (!!!) worth of orders doesn't jive to me.
NY is already a notoriously slow shipper; I suspect that they were still trying to figure out how in the world to ship such a massive order when they got the first emails and, in NY fashion, decided to wait to respond until they had their ducks in a row; if then they got a MASSIVE chargeback all of a sudden, they then went into Japanese Shop Screw You Mode and cancelled the account because from their end, they just got bilked out of SEVEN THOUSAND DOLLARS. At that point, you're never going to hear from them, because they're pissed.
I don't care for NY and would never, ever order from them myself, but I think there's another side to this.
All of that is taking the details here at face value. I raise an eyebrow at someone who is willing to drop $7k USD on figures in one sitting existing doing it on NY, a site known for bad customer service and inflated shipping costs -- surely your first course of action would be to use a retailer that's responsive and won't overcharge you for what is sure to be an absurdly massive order? If you're spending that much on figs you're obviously familiar enough with the hobby to know multiple retailers.
Idk, call me cynical, but this doesn't quite add up.

I'm still thinking about this situation, lol ... especially since NY JUST shipped me a PO (no problem, pretty quick turnaround on the handling time).

It sounds like your friend ordered a combination of maybe 50+ figures all with different release dates? That's a lot for a smaller niche shop to handle, tbh. Maybe she just got nervous / impatient (and then pissed them off filing claims)? I totally agree that NY and other Japanese shops really need to work on the temper tantrums cancelling accounts when they don't like customers expecting, um, customer service .... BUT ... wow, idk. I wouldn't recommend ordering this many figures in one go. Probably AmiAmi or HLJ or Hobby Search could handle it and would break up the shipment into multiple boxes (and TOM would likely ship you one damn thing in an enormous box at a time) ... but NY seems less equipped for it?

Sadly you can't do anything as the transaction was made months ago, that's why i hate preorders. Got burned the same way with 200 $, by yokatta. You can't get your money back in this case just hope you get the items.

ddarko (6 dag(en) geleden) #71235379Did he pay with debit? If he paid with Credit or Paypal, he can actually get Paypal or the bank to step in. With a CC, your purchases are usually insured too (and what has happened actually could qualify as "fraud").
P.S. This is just an observation, $7000 for a purchase of figures sounds like a lot!! My entire collection at the moment (and if I throw in my display cabinets too) is probably half of that. Woah!

I didn't get the exact list but the update might she'd some light on that.

I think the friend has a habit of saving up for a long time and then splurging. I can't recall tho
